The challenge of the State Government through the present Writ Petition is to an award passed by the Labour Court dated 04.05.2006 in Case No. 33/ID Act (Ref.)/2004 wherein the Labour Court had allowed the claim of the Respondent against his illegal termination granting relief of reinstatement without back wages. The Petition was filed in the year 2007. 2.

Learned Sr. Advocate for the Respondent workman submits that pending the Petition the State Government had already reinstated the Respondent-workman in service in compliance of the award passed by the Labour Court and subsequently vide Order dated 03.09.2008 has also been regularised in service under State Government.

In view of the subsequent development that has taken place particularly to the extent that the service of the Respondent having been reinstated by the Petitioner further also regularised his service no fruitful purpose would be served if the case is now decided on merit. Even otherwise, the equity jurisdiction lies more in favour of the Petitioner. 4.

Accordingly, the Writ Petition is dismissed.
