Hon'ble Shri Justice P. Sam Koshy Order On Board 27/11/2015

1. The petitioner by way of this petition sought for promotion to the post of Assistant Engineer from the post of Junior Engineer.

2. The State counsel submits that the State has already filed its reply on 27.11.2008. A copy of the said reply with endorsement to the filing counter of the Registry is also shown to the court, however, record of this court did not contain the said reply of the State.

3. The Registrar (Judicial) of this Registry is directed conduct an enquiry in this regard on administrative side and submit its report before this court within a period of three weeks from today.

4. Meanwhile, a perusal of reply filed by the State, it would reveal that during pendency of this petition, on 19.09.2008 the case of the Petitioner was duly processed and was granted promotion to the post of Assistant Engineer and posted at Janpad Panchayat, Baderajpur, District Bastar (CG), a copy of which

is also enclosed along with reply as Annexure R/1.

5. Copy of reply dated 27.11.2008 along with Annexure R/1 filed by the State is taken on record.

6. As the grievance of the petitioner has already been redressed way-back in the year, 2008 itself, at this stage, nothing remains in this petition for further adjudication.

7. Accordingly, the writ petition is dismissed as having become infructuous. No order as to costs.
