Learned counsel for the applicant wants to withdraw the present application. She submits that if the applicant surrenders before the Court below and move an application under Section 439 Cr.P.C. for grant of regular bail, the trial Court may be directed to consider the said application on the same day.

As prayed for, the instant application is dismissed as withdrawn. However, in the event the applicant surrenders himself before the concerned Sessions Court and moves an application under Section 439 Cr.P.C. for grant of regular bail, the same shall be considered, if possible, on the same day.
