The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.336/2015 registered in Police Station Arjuni, District-Dhamtari (C.G.) for offence punishable under sections 419, 420, 467, 468, 201, 120 (B) of Indian Penal Code. 2.

As per the prosecution case the applicant who was the Manager of Shyam Cold Storage alongwith other co-accused sold 1300 bags of Mahuwa to Chhotu @ Indresh Dewangan for Rs.9 lakhs and the said Mahuwa was deposited by one Vinod Sao in the Cold Storage belonging to Nanak Chand Agrawal.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and the said Mahuwa was not sold by the applicant, charge sheet in this case has been filed. He submits that one more co-accused Sunil Thakre has been enlarged on bail by the coordinate bench of this court in M.Cr.C. No.2393/2016 on 19/05/2016,

therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail, however do not dispute the fact that similarly placed co-accused has been enlarged on bail by the coordinate bench of this court in M.Cr.C. No.2393/2016 on 19/05/2016.

Considering the facts and circumstances of the case, charge sheet has been filed, applicant is in jail since 12/01/2016 and also for the fact that similarly placed co-accused has been enlarged on bail by the coordinate bench of this court in M.Cr.C. No.2393/2016 on 19/05/2016, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
