Petitioner is the complainant. His complaint under Section 138 of Negotiable Instrument Act against the respondent was decided by the trial Court acquitting the respondent from the offence charged against him.

Considering the grounds mentioned, this application is allowed. Leave is granted to file acquittal appeal. Registry is directed to register the case as acquittal appeal and proceed accordingly.

Accordingly, the application for leave to appeal stands disposed off.
