This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.59 of 2015, registered at Police Station-G.R.P.Charoda, Bhilai (C.G.), for the offence punishable under Sections 380 and 457 of the IPC.

Case of the prosecution, in brief, is that, the applicant has stolen DVD, mobile and other domestic appliances from the house of complainant Chintu Kumar amounting to Rs.4500/- on 8.5.2015. 3.
After hearing the learned` counsel for the parties and taking into consideration the facts and circumstances of the case; further taking into consideration the nature and gravity of offence and the fact that stolen article has been recovered from the possession of the applicant, this Court is not
inclined to release the applicant on regular bail. 4.
Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
