Rejection of application for grant of compassionate appointment has been assailed on the ground that even if the petitioner was minor at the time of death of his father, upon attaining majority, he ought to be considered for compassionate appointment.

Learned counsel for the petitioner could not point out any provision in the compassionate appointment policy that in the event, the dependents are minor, upon attaining majority, they can apply. According to the policy, minimum age of appointment is 18 years. The petitioner, at the time of death of his father, was a minor. Therefore, on the ground of sympathy, this Court is unable to extend any benefit to the petitioner. Therefore, this petition is dismissed. Dismissal, however, will not affect the claim of either the widow or any other major dependents of the deceased employee.
