Hon'ble Shri Justice Goutam Bhaduri Order 15/07/2016 1.
Both these bail applications are decided by this common order as they are arising out of the same crime number. 2.
The applicants have preferred these applications for grant of bail as they are arrested in connection with Crime No.72/2016 registered in Police Station Saraipali, Dist. Mahasamund (C.G.) for offence punishable under section 395 of Indian Penal Code.
3.
As per the prosecution case in the intervening night of

4.
Learned counsel for the applicants submits that the applicants have been falsely implicated in this case and they have not been identified. He submits that FIR was against unknown persons and no substantial recovery has been made, therefore the applicants may be released on bail.
5.
Learned State counsel opposes the prayer for grant of bail. 6.

On the basis of call details, the applicants were apprehended and subsequently the mobile which was looted was seized from the applicant Shrawan Kumar Sahu and on the basis of the evidence further the other applicants were apprehended.
