Hon'ble Shri Justice Chandra Bhushan Bajpai Order On Board 20-6-2017
1. Heard on I.A. No. 1/2017 for condonation of delay in filing instant MCC as the same has been preferred after 81 days of its limitation.
2. Learned counsel for the R-6/State accepts notice on behalf of the R-6.
3. On due consideration, this Court is of the view that the applicant has satisfactorily explained the cause of delay of 81 days in filing instant MCC. Consequently, I.A. No. 1/2017 is allowed and delay in filing instant MCC is allowed.
4. Learned counsel for the applicant submits that on the date of hearing i.e. 10-2-2017, other respondents were not represented, only R-6 was represented. With this, the matter may be disposed of without noticing other respondents.
5. On due consideration, the matter is heard finally even without noticing the other respondents.
6. On due consideration, instant MCC is allowed. FA No. 138/2004 dismissed for want of prosecution on 10-2-2017 is restored to its original number.
7. No order as to costs.
