The applicant is apprehending his arrest in connection with Crime No.143/2015 registered at Police Station Kotwali, District-Raigarh (C.G.) for alleged commission of offence under Section 294, 366(A), 370, 511 and 120(B) of IPC read with Section 67, 67(A), 67(B) of I.T. Act and Section 11 & 18 of Protection of Children from Sexual Offences Act, 2012. 2.

Case of the prosecution is that the applicant and other accused are involved in sexually exploiting the minor girl in the Girls Orphanage Home. 3.

Learned counsel for the applicant argues that the entire case of the prosecution against the applicant only contained some kind of conversation and an attempt made by the applicant in connivance with co-accused the Superintendent of orphanage home for arranging girls for sexual enjoyment but there is no allegation of actual commission of any such offence. 4.

It is a case of false implication and looking to these circumstances, the applicant may be protected by application for anticipatory bail as he is a Government servant.

On the other hand, learned counsel for the State opposes prayer for grant of bail and submits that the investigation so far as revealed a racket involving superintendent of Orphanage Home of girls involved in trafficking minor girls for sexual exploitation, in which, there is active involvement of the present applicant is also. 6.

Taking into consideration the nature and gravity of allegation against the applicant, I am not inclined to grant anticipatory bail to the applicant. 7.

The bail application is rejected.
