This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.50/2016, registered at Police Station - Khursipar, District - Durg (C.G.) for the offence punishable under Section 457, 380 of the Indian Penal Code. 2.

Case of the prosecution, in brief, is that on 09.02.2016, a report was made by the complainant Ranjita Dewar alleging that LED TV has been stolen. Subsequently on investigation from the possession of the applicant, LED TV was recovered. Thereby the offence has been committed.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case as the complainant's husband was beaten by the applicant. It is further submitted that chargesheet in this case has been filed and the applicant is in jail since 04.05.2016, therefore, counsel prays that the applicants may be enlarged on bail.

On the other hand, learned counsel for the State opposes the bail application.

I have heard learned counsel appearing for the parties. 6.

Perused the case diary and documents. Perusal of the document shows that from the possession of the applicant, stolen TV was recovered. Considering the fact that under similar like nature, 7 cases are registered against the applicant, I am not inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is dismissed.
