Heard on I.A. No. 1, which is an application for condonation of delay.

On due consideration, the explanation given in the application is satisfactory, therefore, the delay of 48 days in filing the MCC is condoned.

This MCC has been preferred for restoration of W.P.(C) 2442/2008 which was dismissed for non-prosecution. The reason assigned by the counsel in restoration application being satisfactory and same is allowed.

Accordingly, MCC is allowed.

The order dated 28/03/2016 is recalled.

W.P.(C) No. 2442/2008 is restored to its original number. No order as to cost.
