1. Heard.

2. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.426/2014 (Special ST No.5/2015 pending in the Court of Special Judge (Atrocities), Raipur} registered at Police Station Kharora, Distt. Raipur for the offence punishable under Sections 302 of the IPC and 3 (2) (v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

3. This is the second bail application filed on behalf of the applicant for grant of regular bail. First bail application of the applicant has been dismissed for want of prosecution vide order dated 11-5-2015 passed by this Court in M.Cr.C.No.1605/2015.

4. Case of the prosecution, in brief, is that the applicant is said to have caused death of Ganpat Khunte on 26-11-2014 by assaulting him with hands and fists.

5. After hearing learned counsel for the parties and considering the material collected by the prosecution and the material available on record, I do not find any ground to grant bail to the applicant. The application is, therefore, rejected.
