Hon'ble Shri Justice Chandra Bhushan Bajpai Order On Board 29-61. Heard on I.A. No. 1/2017 for condonation of delay in filing instant MCC as the same has been filed after 208 days after dismissal of WPL No. 2427/2007 on 11-11-2016 for want of prosecution.

2. It is submitted that the counsel representing the applicant in the said WPL had returned the brief on account of his ailment and other facts hence the applicant was not represented when the matter was taken up for hearing.

3. On due consideration this Court is of the considered view that the applicant had satisfactorily explained the cause of delay in filing the instant MCC after 208 days from order passed.

4. Consequently, I.A. No. 1/2017 is hereby allowed. Delay is condoned.

5. Also heard the matter finally.

6. On due consideration, instant MCC is allowed. WPL No. 2427/2007 dismissed for want of prosecution on 11-11-2016 is restored to its original number.

7. No order as to costs.
