1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 30 of 2016 registered by Police Chowki Lodam P.S. Jashpur, Distt. Jashpur (C.G) for the offence punishable under Sections 363 & 370 IPC.
2. As per the prosecution case, on 11.02.2016 a report was made by the father of victim girl that prior to four months the applicant took away the victim on some allurement and thereafter took her to Delhi.
3. Learned counsel for the applicant submits that there is long delay of four months in filing the FIR and the applicant has been falsely implicated and the girl went along-with the applicant with the consent of her parents. He further submits that the charge sheet has been filed; no further investigation is necessary and since the applicant is in jail since 09.03.2016, she may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail.
5. Perused the case diary and the statements of victim recorded u/ss 161 & 164 of Cr.P.C., wherein it is stated that the applicant forcibly took away the girl to Delhi and on being resisted, she was assaulted and abused by the applicant.
6. After going through the statements of prosecutrix and considering the gravity of allegations leveled against the applicant, I am not inclined to release him on bail.
