(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 115/2013 registered at Police Station Jarhagaon for the offences punishable under Sections 363, 366 & 376 of the Indian Penal Code & under Sections 3-4 of POSCO Act, 2012 and Section 3(2)(v) of the Scheduled Caste & Scheduled Tribe (Prevention of Atrocities) Act.

(2) Taking into consideration the nature and gravity of the offence; further considering the age of prosecutrix, who is said to be the minor on the date of offence and other material collected by the prosecution; I am not inclined to release the applicant on bail. Therefore, the bail application is rejected.
