The grievance of the petitioner is that the benefit of 7th pay commission has not been given to the petitioner though he has been retired after the 7th pay commission was made applicable.

The facts of the case is that, the petitioner working as a Development Extension Officer stood retired with effect from 31/01/2017. The benefit of 7th pay commission was introduced subsequent to his retirement, but was made effective from 01/01/2016 onwards. Initially, the benefit was not given to the petitioner but subsequently vide notification dated 13/12/2017, it has been

decided by the Government of Chhattisgarh that the benefit of revised pay shall be made applicable to the pensioners also who have retired subsequently on 01/01/2016.

In view of the same, this Court is of the opinion that ends of justice would meet if the Writ Petition itself is disposed off with a direction to the respondent No.3 to immediately issue appropriate directions to the concerned officer in the department to process the case of the petitioner for grant of the revised pensionary benefits under the 7th pay at the earliest preferably within a period of 4 months from the date the certified copy is made available by the petitioner to the respondent No.3. 4.
