Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 23/06/2017 (1) Learned counsel appearing for the petitioner would submit that the petitioner's application to grant leave for a period of 19 days under the provision of Rule 6 of CG Prisoner Leave Rules, 1989 is pending consideration before the District Magistrate. Report of the Superintendent of Police has received, but the District Magistrate has not considered and decide the application
till this date.
(2) Be that as it may, the District Magistrate is directed to consider the application of the petitioner in the light of Rakesh Shende Vs. State of Chhattisgarh passed in Writ Petition (Cr) No.29 of 2016, decided on 18.11.2016 expeditiously preferably within a period of 30 days from the date of receipt of certified copy of this order.
(3) With the aforesaid observation, the writ petition stands finally disposed of.
