--- Respondent For Petitioner :

Mr. V.K. Pandey, Advocate For State :

Mr. Shashank Thakur, Govt. Advocate Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 23/06/2017 (1) By the impugned order dated 09.05.2017, the petitioner/plaintiff's application under Order 7 Rule 14 of CPC to produce additional documents has been rejected by the trial Court as it has been filed belatedly.

(2) Learned counsel appearing for the petitioner would submit that the production of additional documents is absolutely necessary for proper adjudication of the case.

(3) I have heard learned counsel for the parties and perused the impugned order.

(4) The plaintiff's evidence has already been closed by the trial

Court. The sufficient and valid reasons have been assigned by the trial Court as the suit was instituted on 03.08.2005, which is pending for more than 12 years. I do not find any jurisdictional error in the impugned order in rejecting the application under Order 7 Rule 14 of CPC filed by the petitioner/plaintiff.

(5) Consequently, the writ petition filed under Article 227 of the Constitution of India deserves to be and is hereby dismissed. Sd/- (Sanjay K. Agrawal) Judge L/-
