At the outset, learned counsel for the State placed before this Court an order dated 11/05/2016 passed in Writ Petition (S) No. 1705/2016 filed by this petitioner raising same issue as is raised in this petition. That petition was disposed off, but now second petition has been filed suppressing the fact that earlier, a petition was filed on the same ground, which is disposed off by this Court.

Considering the aforesaid aspect, this second petition is not maintainable and for suppressing of fact, this petition is liable to be dismissed and is accordingly dismissed with cost of Rs. 1,000/-, which is payable to the High Court Legal Aid Committee.
