Order On Board 15/9/2015 Heard finally with the consent of learned counsel for the parties. (2) The petitioners are working as Assistant Teachers/Upper Division Teachers in the Ashram Schools run by respondent No.5, which is a fully aided private institution.
(3) The petitioners have prayed that they are entitlement to the pay scale recommended by 6th Pay Commission, however, their claim in respect of the same is not considered by respondent No.5. (4) Learned counsel for the respondents would submit that there was some dispute with regard to the petitioners' appointment and continuation, however, they would admit that at present, the petitioners are continuing on the post.
(5) Without going into the issue as to whether the petitioner's appointment or their continuation was valid or not, the writ petition is disposed of with a direction that in the event, the petitioners prefer fresh representations in respect of grant of benefit of 6th Pay Commission Scale, before respondent No.3 with a copy to respondent No.5, the respondent No.3 shall decide the representations by a speaking order, at the earliest, preferably within a period of 3 months from the date of submission of representations.
