1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No.73/2021 registered at Police Chowki Mohara, P.S. Dongargarh, Distt. Rajnandgaon (C.G) for the offences punishable under Sections 509-B of IPC and Section 67 of the Information Technology Act.

As per the prosecution case, in order to break the marriage of victim/prosecutrix and further to tarnish her image, edited photographs were uploaded in the face book of the applicant showing that she was already married by putting vermilion on her forehead. It is also alleged that the applicant used to send obscene messages to the victim.

3. Learned counsel for the applicant submits that the prosecutrix has been examined and she has not supported

the case of prosecution. He further submits that the applicant is in jail since 17.01.2021; charge sheet has been filed and no further investigation is necessary, therefore, he may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail application.

5. A perusal of the statement of prosecutrix shows that she has not supported the case of prosecution. Considering the statement of prosecutrix, without any observation on merits of the case, I am inclined to allow this bail application.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court for his appearance before the said Court as and when directed.
