Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 03/08/2016 Learned counsel for the petitioner submits that though the compassionate appointment has been offered to the petitioner vide memo dated 15/12/2014, the petitioner expressed his difficulty to accept the appointment on the offered post and his mother submitted a representation on 15/09/2015 for considering the petitioner for appointment to some other post. 2.

Letter dated 13/05/2015 clearly shows that as per policy, the compassionate appointment has to be given in that office or in the department, in which, the deceased has been posted. The petitioner has been offered a post of Constable (GD).

The representation which has been made by the petitioner may be

considered according to the policy. If the policy terms permits appointment in the same department and office, though on other post subject to availability of vacancy, claim of the petitioner may be considered and decided within a period of three months.
