(1) Respondents No. 2 & 3 invited applications on 4th February, 2008 for appointment on the post of Senior Treatment Supervisor, in which, petitioner submitted his candidature for the said post but anyhow said posts could not be fulfilled and advertisement was cancelled finding non-compliance of reservation roster.

(2) Again on 13.07.2011, fresh advertisement for the said post was published by respondents No.2 & 3 on contract basis for a period of one year.

(3) The petitioner filed writ petition on 14.10.2011 pleading that advertisement dated 13.07.2011 be quashed and respondents be directed to consider the petitioner's case in light of advertisement dated 4.2.2008.

(4) It appears from the records and representation (Annexure P-7) filled by the petitioner on 19.09.2011 that petitioner is claiming appointment on the basis of advertisement invited on 4th February, 2008, he has not claimed candidature pursuant to the advertisement and applications invited on 13.07.2011 and the applications were invited for appointment on contractual basis for a period of one year; and that has already been expired and one Prabhat Kumar Barwa has already been appointed on the said post for a period of one year, as such no relief can be granted to the petitioner. (5) For the reasons mentioned hereinabove, the petition being devoid of merit is liable to be and is hereby dismissed. No order as to costs.
