This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.185/2016, registered at Police Station - Chakarbhatha, District - Bilaspur (C.G.) for the offence punishable under Section 370 of Indian Penal Code. 2.
Case of the prosecution, in brief, is that a complaint was lodged by a lady that she was known to the applicant and used to perform musical dance with her husband and they also used to sale penden along with the applicant. Therefore, the applicant allured the complainant to earn more amount if she agrees to physically sell herself in prostitution and on 01.06.2016 again allurement was made for which a report was made.

Learned counsel for the applicant submits that because of the dispute in between the parties about the payment of amount, the false report has been made. It is further submitted that the applicant is in jail since 06.06.2016 and the charge sheet in this case has been filed, therefore, the counsel prays that the applicant may be enlarged on bail.

On the other hand, learned counsel for the State opposes the bail application.

I have heard learned counsel appearing for the parties. 6.
Perused the case diary and the documents. Considering the facts and circumstances of the case the nature of offence and the degree of allegation levelled against the applicant and further considering the fact that charge sheet in this case has been filed and the applicant is in jail since 06.06.2016, this Court is of the opinion that present is a fit case, in which, the applicant should be enlarged on regular bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that applicant shall be released on bail on her furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisf action of the concerned trial Court, for her appearance as and when directed. 9.
