AG Order on Board by Hon'ble Shri Justice Pritinker Diwaker /05/2018 This application under Section 438 of the Code of Criminal Procedure has been filed by the applicant who is apprehending his arrest in connection with Crime No. 14/2018 registered at Arakshi Kendra, Cabhara, District Janjgir Champa for commission of the offence punishable under Sections 456, 354 and 323 IPC.

Counsel for the applicant submits that he wants to withdraw this application for anticipatory bail with liberty to file a regular bail application before the trial Court. He however submits that a direction may be issued to the trial Court for deciding the case on the same day. 3.
State counsel has no objection to the prayer for withdrawal of the anticipatory bail application with liberty to file the one for regular bail before the trial Court. He however expresses his strong objection as far as the prayer for direction to the trial Court is concerned for deciding the application for regular bail on the same day.

Application for anticipatory bail is accordingly dismissed as withdrawn with liberty to file application for regular bail before the trial Court. Needless to say that if any such application is filed, the trial Court/Sessions Judge shall decide the same in accordance with law.
