3.

Amit Kumar Tiwari, S/o Shri Satish Kumar Tiwari, Bus Operator, R/o Village Tala, Tahsil Majoli, District Sidhi (MP). --- Respondents For Petitioner :

Mr. Santosh Gupta, Advocate For State :

Mr. Prasun Bhaduri, Govt. Advocate Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 19/07/2017 (1) Learned counsel appearing for the petitioner while granting permit to the respondent No.3 by respondent No.2-Secretary State Transport Authority, Raipur, the petitioner has raised objection before the respondent No.1-State Transport Appellate Tribunal, Raipur, which has not been considered and decided till now by respondent No.1. (2) I have heard learned counsel for the parties. (3) A careful perusal of the order of respondent No.1-State Transport Appellate Tribunal, Raipur would show that the petitioner's objection has been considered and thereafter, permit has been granted to the respondent No.3.

(4) After hearing learned counsel for the parties, I am of the considered opinion that respondent No.1-State Transport Appellate Tribunal, Raipur has assigned sufficient and valid reasons in granting permit to the respondent No.3 in which I do not find any jurisdictional error in the impugned order. Consequently, the writ petition deserves to be and is accordingly dismissed. However, the petitioner is at liberty to make objection before the respondent No.1 at the time of renewal. SD/- (Sanjay K. Agrawal) Judge L/-
