Though certain defaults have been pointed out, learned State counsel pointed out that present is an appeal arising out of order dated 16/03/2020 passed by the learned Single Judge in exercise of supervisory jurisdiction under Article 227 of the Constitution of India.
Heard learned counsel for the appellant on the aspect. The petitioner filed petition under Article 227 of the Constitution of India aggrieved by order dated 06/05/2015 passed by Chhattisgarh State Co-operative Tribunal in an appeal.
We find that the petitioner filed petition under Article 227 of the Constitution of
India only. The petitioner has not prayed for any relief in the petition except seeking quashment of order passed by the State Co-operative Tribunal in the appeal. The petition is neither styled under Article 226 of the Constitution of India and / or under Article 227 of the Constitution of India nor the relief sought in the writ petition show that the petitioner sought issuance of any of the writs. Therefore, this appeal is not maintainable. The order impugned being one passed by the learned Single Judge in exercise of its supervisory jurisdiction under Article 227 of the Constitution of India.
The appeal is accordingly dismissed.
