(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No.20/2015 registered at Police Station Sankra, District Mahasamund for the offences punishable under Sections 363, 366, 376 & 506/34 of the Indian Penal Code and Section 4 of Protection of Children from Sexaul Offences Act, 2012.

(2) Taking into consideration the facts & circumstances of the case; further considering the age of the prosecutrix and her statement recorded under Section 161 Cr.P.C.; and considering the fact that case of the present applicant is distinguishable to the other co-accused namely Dinesh Nishad, who has already been granted bail by this Court vide order dated 4.5.2015 passed in M.Cr.C.
