1. Mr. V.R. Tiwari, learned counsel appearing for the respondents / SECL, would submit that the impugned order is appealable before the appellate authority under clause 30 of the Standing Orders in respect of SECL, Bilaspur.

2. Mr. Ashok Kumar Shukla, learned counsel for the petitioner, would submit that the petitioner may be allowed to prefer appeal, but the appellate authority be directed to dispose of the appeal expeditiously.

3. This is the petition of the year 2007. This Court is not inclined to relegate the petitioner to the remedy of appeal, but looking to the fact that disputed question of fact is involved, it would be appropriate to relegate the petitioner to the appellate authority for filing appeal.

4. The petitioner is permitted to file appeal as per clause 30 of the Standing Orders within 15 days from today and the appellate authority would do well to dispose of the same after noticing the other side by passing a reasoned and speaking order within 45 days from the date of filing of appeal.

5. With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
