On due consideration, this Court is of the considered view that the applicant has satisfactorily explained the delay of 119 days. Consequently, IA No.01/17 is hereby allowed and the delay of 119 days in filing the instant MCC is hereby condoned. 3.
The matter is admitted for consideration.

Learned counsel for the applicant would submit that respondents 2 & 3 were not represented when FA No.36/2000 was called up for hearing, hence, the instant MCC may be disposed of without even noticing the respondents 2 & 3. 5.
On due consideration, instant MCC is allowed. FA No.36/2000 dismissed for want of prosecution on 17.02.2017 is restored to its original number. No order as to cost. Sd/- (Chandra Bhushan Bajpai) JUDGE Bini
