This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.153/2014, registered at Police Station-Basna, Distt.Mahasamund (C.G.), for the offence punishable under Sections 302/34 & 307/34 of the IPC and 25/27 of the Arms Act.

After hearing learned counsel appearing for the parties, taking into consideration the facts and circumstances of the case, the manner in which the applicant along with co-accused persons is said to have assaulted deceased Tirath Ram Baghel on 28.4.2014 by which he suffered death, taking into consideration the testimony of eye witness Malti Baghel (PW-1) and other prosecution witnesses and material collected on behalf of the prosecution, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
