1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.238/2019 registered at Police Station Dharamjaigarh, District Raigarh (CG) for the offence punishable under Sections 302, 201 of the IPC.

3. The applicant was not pulling on well with his wife Geeta Yadav (deceased). One Dukalu lodged merg intimation informing the

MCRC No. 1675 of 2020 Police that the deceased died due to hanging. However, in the postmortem examination, the deceased was found to have died due to strangulation, homicidal in nature.

4. The applicant's memorandum statement was recorded on 30.11.2019 and more importantly, he and the deceased were the only two persons present in the house at the time of the incident.

5. Considering that the husband and the deceased were the only two persons present in the house and the applicant did not inform about the incident but pretended that the deceased died due to hanging, this Court is not inclined to release the applicant on regular bail.

6. Accordingly, the bail application is dismissed. However, the applicant would be at liberty to move afresh, in the event, the trial does not show sufÏcient progress within reasonable time. Sd/- (Prashant Kumar Mishra) Judge Shyna
