1. The grievance of the petitioners in the present writ petition is that the Promotion Committee i.e. Respondent no.5 & 6 have already recommended for grant of promotion to the petitioner to the next higher post and matter is still pending consideration before respondent no.4 District Education Officer.

2. The limited prayer that petitioner prays is for appropriate direction to respondent no.4 to take decision strictly in accordance with the rules and

regulations governing the field on the recommendation made by the respondent no.5 & 6.

3. The limited prayer is not opposed by the State counsel.

4. Accordingly, the writ petition stands disposed of directing the respondent no.4 to take a decision on the recommendation made by respondent no.5 & 6 so far as grant of promotion to the petitioners to the next higher post is concerned.

5. Let a decision be taken by respondent no.4 at the earliest preferably within a period of 60 days.

6. It is made clear that this Court has not expressed any opinion on the merits of the case so far as entitlement of the promotion to the petitioners are concerned. Respondent no.4 shall take a decision strictly in accordance with law.
