The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.158/2016 registered in Police Station Khursipar, Durg (C.G.) for offence punishable under sections 354, 456 of IPC and Section 8 of Protection of Children from Sexual Offences. 2.

As per the prosecution case, on 17/04/2016 the applicant entered into the room of the prosecutrix who was neighbour, thereafter caught hold of her hand and pressed her breast and prosecutrix having raised alarm, mother of the prosecutrix came and thereafter applicant fled away. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and no offence has been committed, the applicant is the neighbour and therefore there has been some dispute was existing and therefore applicant has been implicated in this case. Learned counsel submits that therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail.

Considering the facts and circumstances of the case, degree of allegation, charge sheet has been filed and applicant is in jail since 26/04/2016, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
