This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.185/2016 registered at Police Station- Jhagrakhand, District Korea (C.G.) for the offence punishable under Sections 379, 387, 436/511 of I.P.C. The first bail application was dismissed on 20.03.2017.

Case of the prosecution, in brief, is that a report was made by T.P. Singh on 16.11.2016 that certain papers were stolen from the dickey of the motorcycle and in lieu thereof certain demand were made on mobile No.9424253052 from two mobile Nos. i.e. 9522806239 & 9522504083 and Rs.5 Lakhs were demanded in lieu of the papers and thereafter mobile were seized. 3.
Learned counsel for the applicant submits that the complainant has been examined and he has not deposed anything against the present applicant; therefore, he may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the case diary and record. There is no statement of the victim on record. Primarily, no change of circumstances appears to be exists to reconsider the instant second bail application; therefore, I am not inclined to enlarge the applicant on bail. 6.
Accordingly, the second bail application filed under Section 439 of Cr.P.C. is dismissed.
