1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.257/2014 {Criminal Case No.1422/2014 pending in the Court of Judicial Magistrate First Class, Kurud}, registered at Police Station Bhakhara, Distt. Dhamtari, for the offence punishable under Section 420 read with Section 34 of the IPC.

2. This is the second bail application filed on behalf of the applicant for grant of regular bail. First bail application has been dismissed as withdrawn with liberty to file after examination of material prosecution witnesses, vide order dated 24-2-2015 passed by this Court in M.Cr.C.No.813/2015.

3. Case of the prosecution, in brief, is that the applicant obtained Rs.6,85,000/- from the complainants to secure job for them in the Government office.

4. Learned counsel for the applicant submits that the applicant has not committed any offence and he has been falsely implicated in the case. There is delay in lodging the FIR which has not been explained and as such, the applicant is in jail since 28-11-2014 and, therefore, he be released on bail.

5. On the other hand, learned State counsel opposes the application.

6. I have heard learned counsel for the parties and perused the case diary.

Taking into consideration the nature and gravity of offence and evidences of the prosecution witnesses namely Kanhaiyalal (PW-1), Dhanushram Dewangan (PW-2), Vikas (PW-3), Somprakash (PW-4) & Laxmikant (PW-5), I do not find it a fit case for grant of regular bail to the applicant. The application is, therefore, rejected.
