Learned counsel for the appellant appearing in two appeals state that both of them have received instructions from the family members of the appellant to file appeal.
Once an appeal has already been filed, there is no occasion to file another appeal against the same judgment of conviction and sentence. Therefore, at this stage, learned counsel for the appellant appearing in Cr.A.No.425/2019 submits that he may be allowed to withdraw this appeal as the appeal on behalf of the appellant - Dhaneshwar Yadav has already been filed.
Prayer is allowed.
Cr.A.No.425/2019 is accordingly dismissed as withdrawn. Certified copy of the impugned judgment be returned to the counsel after retaining photo copy of the same.
Cr.A.No.1521/2018 shall survive for adjudication in the matter of conviction of the appellant - Dhaneshwar Yadav @ Dhaniya Yadav. Four weeks' time is granted to the counsel for the appellant to file certified copy of the impugned judgment in this appeal. Cr.A.No.1521/2018 be listed after four weeks.
