Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 27/07/2017 (1) In appeal preferred by the petitioner against the orders passed by Collector, Mahasamund and Additional Commissioner, Raipur has rejected the application for stay filed by the petitioner against which, this writ petition under Article 226/227 of the Constitution of India has been filed by the petitioner herein.

(2) Learned counsel appearing for the petitioner would submit that the Collector, Mahasamund and Additional Commissioner, Raipur have committed jurisdictional error in rejecting the application for stay.

(3) Since the petitioner's application for stay has been rejected exparte, I deem it appropriate to direct the Additional Commissioner, Raipur to notice the other side and thereafter, petitioner's application for stay would consider and decide the same within a period of three weeks from the date of receipt/production of copy of this order. (4) With the aforesaid observation, the writ petition stands finally disposed of.
