1. The applicant has preferred this bail application under Section 439 of Cr.P.C. as he has been arrested in connection with Crime No.20/2021 registered at Police Station- Sankra, District Mahasamund, C.G. for the offence punishable under Section 489 C of Indian Penal Code.

2. The matter is listed for order on default as the counsel for the applicant has filed MCRC under Section 439 of CRPC instead of CRA under Section 21(4) of N.I.A. Act.

3. In view of above, learned counsel for the applicant seeks to withdraw the same with liberty to file appropriate appeal before the appropriate Bench. However, he prays for return of certified

copy of the impugned order.

4. Permission granted.

5. Accordingly, the bail application stands dismissed as withdrawn with the aforesaid liberty.

6. Registry is directed to return the certified copy of the impugned order to the counsel for the applicant on his furnishing true authenticated Xerox of the same.
