ORDER

This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.282/2018 registered at Police Station Lormi, District Mungeli, for the offence punishable under Sections 420, 170, 171, 419 of I.P.C. & 66(D) of I.T.Act. 2.

As per the prosecution case, the applicant misrepresented himself to be the police and on the false personification assured the complainant to get them job in the police department and thereby extracted money of Rs.1,40,000/-. Subsequently, it was revealed that the entire promise was fake and personification. 3.

Learned counsel for the applicant submits that the charge sheet has been filed, the applicant is in jail since 21.07.2018 and the trial has not been completed; therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Considering the time of detention as against the allegation of charges and taking into fact that the applicant is in jail since 21.07.2018, I am inclined to release the applicant on bail. Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed. Sd/- (Goutam Bhaduri) Judge Ashok
