The petitioner has preferred this writ petition seeking benefit of selection grade pay scale (Pravar Shreni Vetanman) in terms of Circular dated 01.04.2013 (Annexure P/4).

Learned counsel for the petitioner would submit that the petitioner was

appointed as Medical Officer on 24.02.2000 and was due for promotion in the year 2006. However, his name was not considered for promotion due to nonavailability of ACR of the year 2001-02. Later on, he was promoted to the post of Surgety Specialist (First Class) on 31.01.2011. According to the petitioner, he should have got his first promotion in the year 2006 instead of 2011.

Considering the fact that the State has not filed any return despite lapse of about 2 years, the writ petition is disposed of with a direction that the petitioner shall submit a detailed representation before respondent No.1 within a period of 4 weeks from today raising his grievance about denial of promotion in the year 2006. On such representation being filed, respondent No.1 shall consider and decide the petitioner's representation on its own merits, by a speaking order, at the earliest, preferably within a period of 4 months from the date of submission of representation.
