1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicants in connection with Crime No.75/2021 registered at Police Station Kharora, Raipur (C.G) for the offences punishable under Sections 6, 10, 11 of Chhattisgarh Agricultural Cattle Preservation Act, 2004 and Section 11(d) of The Prevention of Cruelty to Animals Act, 1960.

2. As per the prosecution case, on 19.02.2021, as many as 65 cattle were loaded in two Trucks bearing Regn. Nos. MH-30/ L /1292 & M.H.36-1943 and were being taken to a slaughter house situated at Nagpur. It is alleged that the cattle were subjected to cruelty while transporting them to Nagpur.

3. Learned counsel for the applicants submits that the applicants are dealing in business of cattle and the

allegations levelled against them are completely baseless. He submits that the applicants are in jail since 19.02.2021 , charge sheet has been filed and no further investigation is necessary, therefore, they may be released on bail.

4. Per contra, learned State Counsel opposes the bail application.

5. Considering the fact that the charge sheet has been filed; no further investigation is necessary and the applicants are in jail since 19.02.2021, I am inclined to allow this bail application.

6. Accordingly, the bail application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond in sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of the concerned trial Court for their appearance before the said Court as and when directed.
