Agrawal Order On Board 17/07/2017 (1) Learned counsel appearing for the petitioner would submit that certain recommendation has been made by respondent No.3-Sub Divisional Officer (Revenue), Kondagaon against the petitioner on 06.11.2006 by sending the case to the respondent No.2-Chief Executive Officer, Janpad Panchayat, Farasgaon for re-examination the matter of

the petitioner. That has been done beyond the back of petitioner. (2) Learned counsel appearing for the respondent No.7 would oppose the submission made by learned counsel for the petitioner and support the impugned order dated 27.11.2006 passed by respondent No.3-Sub Divisional Officer (Revenue), Kondagaon. (3) Since the Sub Divisional Officer (Revenue), Kondagaon is simply recommended to the Chief Executive Officer, Janpad Panchayat, Farasgaon for re-examination the matter of the petitioner, but no final decision has been taken by the said authority. (4) Be that as it may, respondent No.2-Chief Executive Officer, Janpad Panchayat, Farasgaon is directed to hear the petitioner before taking any action upon the reeommendation of the respondent No.3-Sub Divisional Officer (Revenue), Kondagaon within a period of four weeks from the date of receipt of certified copy of this order. (5) For a period of four weeks, no coercive steps shall be taken against the petitioner.

(6) With the aforesaid observation, the writ petition stands finally disposed of.
