This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 23/2014, registered at Police Station Ramanujganj, for the offence punishable under Section 302 of the Indian Penal Code.

Case of the prosecution, in brief, is that on 26/11/2014 applicant entered into house of deceased and on some dispute, poured kerosene oil on her and set her on fire, thereafter, she suffered burn injury and died. 3.

After hearing learned counsel appearing for the parties and taking into consideration the nature and gravity of offence; dying declaration given by the deceased and material collected by the prosecution, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
