1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 121 of 2016 registered at P.S. Dongargaon (C.G) for the offence punishable under Sections 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

2. As per the prosecution case, on a raid being conducted on 26.5.2016, from the possession of the applicant 3 Kgs., of contraband cannabis was recovered.

3. Learned counsel for the applicant submits that the applicant has been falsely been implicated and the cannabis has not been seized in person from the applicant.

4. Per contra, learned State Counsel opposes the bail.

5. Perused the case diary and documents.

6. Prima facie it shows that seizure has been made from the applicant. Considering the quantity of cannabis i.e., 3 Kgs allegedly recovered from the applicant, I am not inclined to allow the bail application. Accordingly, it is rejected.

7. However, the applicant is at liberty to renew the prayer after the seizure witness is examined.
