This is the second bail application under Section 439 of the CrPC. 2.

His first bail application was allowed by co-ordinate Bench of this High Court on 25/09/2017 in MCRC No. 5756/2017.

The applicant has been arrested in connection with Crime No.232/2017 registered in Police Station Kotwali Jagdalpur, District Bastar (C.G.) for the offence punishable under Section 34(2) of CG Excise Act. 4.

Argument heard.

Earlier bail order dated 25/09/2017 was automatically stand cancelled because applicant was absent on 21/08/2018 without any just and sufficient reason.

Counsel for the applicant submits that he was appearing before the trial Court regularly except 21/08/2018, thus he may be released on bail. 7.

Counsel for the State submits that there is no antecedents of the applicant is reported in police case diary.

Looking to the facts and circumstances of the case,looking to the fact that there is no likelihood of the accused to abscond and tamper the evidence, it is directed that if the applicant furnishes two solvent sureties for a sum of Rs. 25,000/- each along with a personal bond of Rs. 50,000/- to the satisfaction of the concerned Court with the condition that he shall appear before the trial Court at 11.00 am as and when directed till trial and he would cooperate during the trial, he shall be released on bail. 9.
