Order On Board 09/08/2017 (1) Counsel for the petitioner submits that the petitioner / defendant's opportunity to lead evidence has been closed on 27.07.2017 whereas he himself has pleaded for expedient disposal of the trial and, therefore, he may be allowed to examine only two witnesses namely Sanjay & Shesh Shankar Dewangan on the next date of hearing, which is fixed on 11th August, 2017. (2) Prayer appears to be fair & reasonable.
(3) After hearing learned counsel for the petitioner, it would be expedient to examine these two witnesses namely Sanjay & Shesh Shankar Dewangan on the next date of hearing i.e. 11.08.2017 subject to payment of cost of Rs.5,000/- payable to the plaintiff. Order accordingly. However, plaintiff will be at liberty to make application for modifciation. (4) With the aforesaid observations, the writ petition stands finally disposed of.
