Mr. Syed Majid Ali, Advocate For State :
Mr. Rahul Jha, Govt. Advocate Hon'ble Shri Justice P. Sam Koshy Order on Board 08/06/2021 1.
The dispute in the present writ petition seems to be anomaly in the pension which has been fixed for the petitioner. 2.
The learned counsel for the petitioner drew the attention of this Court to the salary details of the petitioner immediately before his retirement. As per Annexure P/5, the petitioner was receiving an amount of Rs.13,620/- + 2,800/- as basic salary for the period between 01.07.2011 till 30.06.2012. Subsequently, from 01.07.2012 till his retirement the petitioner was receiving salary of Rs.14,120/- + 2,800/- i.e. Rs.16,920/-, however while fixing the pension, which is a part of Annexure P/6, the last salary of the petitioner seems to have been shown as Rs.16,350/-, which has never been the salary of the petitioner for last almost two
-2years, therefore according to the petitioner, he is at loss of an amount of Rs.570/- per month, which needs to be scrutinized, verified and settled. 3.
The learned State counsel agrees to the proposal given by the petitioner that let the matter be scrutinized by the Accounts and Pension section under the respondents, who shall scrutinize the last wage drawn of the petitioner and the pension that he would be entitled for under the Rules.
4.
Given the said submission the writ petition at this juncture stands disposed of directing the respondents No.2 & 3 to immediately refer the matter to the concerned Accounts and Pension section under the respondents No.2 & 3, who shall scrutinize the pension papers of the petitioner including the last wage dawn by the petitioner and reach to a conclusion, as to whether the pension of the petitioner fixed by the petitioner is proper or not and if not, necessary corrections should be taken at the earliest preferably within a period of 4 months from the date of receipt of the copy of this order.
5.
With the aforesaid observations, the present writ petition stands disposed of.
