This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 651/2014, registered at Police Station Kurud, District Dhamtari (C.G.), for the offence punishable under Section 379/34 of Indian Penal Code.

Case of the prosecution, in brief, is that applicant is said to have stolen Rs.8 Lacs from the bag kept in the motorcycle belonging to Tikeshwar Verma on 05/12/2014.

After hearing learned counsel appearing for the parties and taking into consideration the consequent recovery made by the applicant; nature and gravity of offence; criminal antecedent of the applicant and manner, in which, applicant is said to have stolen Rs.8 Lacs, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
